Muddy Knees Kids’ Rugby Terms and Conditions (Terms)

Rules for parents and responsible adult

These Terms, as amended from time to time, apply to all Muddy Knees Kids Rugby Limited (“MKKR”) services made available online, through any mobile device, by email or by telephone. By accessing, browsing and using www.muddykneeskidsrugby.com (the “Website” or “Site”) and/or by completing a booking form, you acknowledge and agree to have read, understood and agreed to the Terms set out below.

We are really excited you have chosen to enrol your child in MKKR, the team can’t wait to see you. To ensure that every MKKR session, party and camp (“Session”) are as enjoyable and as safe as possible, we ask parents or the responsible adult (“Parent”) to familiarise themselves with the following guidelines:

Medical and Health

  • Please advise the coach prior to the Session if your child has any medical conditions; however small, (including but not limited to high temperature and/or administration of Calpol or similar paracetamol products) especially in the previous 24 hours prior to the Session.

Supervision at MKKR

  • Please remember that you are responsible for your child at all times throughout the Session. Therefore, we kindly ask Parents to remain present for the duration of the Session to ensure that your child is in sight at all times. If an emergency arises and you have to leave for a short time, please advise one of the coaches and another Parent.
  • MKKR is not responsible for the safety of children, although all reasonable and practicable steps are taken to ensure their safety.

Session and Camp Dates

  • MKKR Session dates normally follow the school term times and therefore consist of a Spring, Summer and Autumn term that will vary in length according to the school term, which will generally mean there will be 39 sessions over the year split across these 3 terms.
  • MKKR Camps run for 2 weeks over the Easter school holiday, for 6 weeks over the Summer school holiday and over each Half Term holiday.

  • Fees
  • Except where the child/children have enrolled for a free trial, Parents shall pay the term and camp fees for the Sessions in advance, and if applicable, the membership fee to MKKR prior to the child commencing any Session.
  • Children may join at any time during the term providing there is space in the Session and fees will be adjusted according to the amount of Sessions left in the term. All Sessions in the remaining term must be booked and paid for in advance.
  • All Sessions are to be paid electronically directly to the Muddy Knees and not by cash or cheque.
  • The Session fees are not refundable after 7 days.

Sibling Discount

  • MKKR offers a 10% sibling discount on for each additional siblings as long as they are booked into Sessions at the same time.
  • The 10% sibling discount does not apply to the Membership fee.

Cancellations

  • Occasionally we are asked to cancel a Session by the local council when ground conditions mean playing would damage the playing area and further be a safety concern for the children. In the event of this or any adverse weather conditions that may affect the safety of the children or any public health circumstances, MKKR have the right to cancel a Session and the fees are not refundable other than with the written consent of MKKR. In the event of cancelled Sessions alternative locations will be offered, where possible.

Duty of Care

  • Whilst we are happy for children to grab a ball and play during arrival we cannot guarantee that they will be watched by a coach at this stage as this is the chance for the coach to discuss any special requirements with Parents.
  • Please help us to ensure that the MKKR Session runs to the correct timings. We would really appreciate it if you could arrive five minutes prior to the start of the Session so you can register and move to your Session specific area ready for the warm-up activities.
  • Please keep siblings, buggies and any obstructive items away from the playing area at all times.
  • If a child or Parent is considered too ill or too injured to play safely or they have a contagious illness that may put others at risk, MKKR has the right to ask that child and their Parent to leave the Session and shall not be responsible for any loss or damage whatsoever arising from such action and will not refund fees for the Sessions that they miss due to the illness or injury.
  • MKKR reserve the right to stop the Session part way through and ask a child and Parent attending to leave if the behaviour of the child is endangering other children. MKKR shall not refund fees under these circumstances.
  • MKKR reserve the right to stop the Session part way through if they feel threatened in any way and feel that it is in their own interest and those of the other children and Parents attending to stop playing. MKKR shall not refund fees under these circumstances.

Drinks and Snacks

  • Having fun can be tiring so we kindly ask Parents to bring a drink for your child to ensure that they remain hydrated throughout and after the Session, as well as a snack to be eaten at the half time break (5 mins) of the MKKR Session.

Family, Friends and Photographs

  • Please be aware your MKKR Session may be full and not able accommodate friends. To avoid disappointment for the child we ask anyone interested in attending to register and pay prior to the Session. Friends and family will not be able to take part in the Session unless this has been done. This policy is operated for insurance purposes and safety reasons.
  • We ask all Parents and other family members and friends to refrain from using photographic and video equipment. Occasionally, a member of the MKKR team or an agent acting on behalf of the MKKR team will take photographs and videos of the Sessions and the children. MKKR has the right to take these photographs and use them for marketing and promotional purposes. If you do not wish your child to be included in these photographs or videos, or have these posted on any social media platform, including but not limited to Facebook, you must immediately request your child not be included at the time of the photograph or video being taken. We may also occasionally share these images with third parties and/or partners for marketing and promotional purposes.

Exclusion of Liability

  • MKKR and their coaches accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay suffered or incurred by the Parent, the child or any other party arising directly or indirectly or in any way connected with the attendance of the child at the Session (or any part of it) or any other act or omission on the part of MKKR, even if such act or omission is negligent.
  • The Parent agrees, for and on behalf of the Parent and the child, that any claim against MKKR, or any coach must be brought within two (2) months of the event that gave rise to such claim. Any claim made thereafter shall be time-barred.
  • The Parent acknowledges, warrants and undertakes, for and on behalf of the Parent and the child, that the maximum aggregate liability of MKKR to the Parent and/or child under these Terms shall not exceed the fee paid for the Sessions (either termly or for a specific camp).
  • All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of MKKR, or their coaches or affects the statutory rights of the Parent or the child.

Confidentiality

  • By agreeing to these Terms the Parent agrees not to share any aspect of the MKKR programme with anyone that is involved or operates in a business in the same market as MKKR.
  • The Parent will not replicate or use any MKKR material directly or indirectly for their own use or a third party, unless the material is purchased from MKKR by the Parent.
  • The Parent agrees not to directly or indirectly be involved in any business which competes with MKKR while the child is paid up for and attending Sessions and for one (1) year thereafter.

Data

  • MKKR agrees not to sell your data to any third party.

Competitions

  • MKKR occasionally runs competitions and MKKR have the final say in the management and running of any MKKR competitions and the decision of MKKR is final.

General

  • By agreeing to these Terms the Parent consents that the data provided (non-financial) can be shared within the MKKR group.
  • The Parent shall indemnify and keep indemnified MKKR against all loss (including loss of profit), liability, cost and expenses which MKKR may incur directly or indirectly as a consequence of any action or inaction of the Parent and/or child.
  • Any notices to be sent by either party to the other shall be sent by pre-paid recorded delivery or hand delivered to the address of the relevant party and shall be deemed to have been received by the addressee within 48 hours of posting or immediately if hand delivered.
  • The failure by either party to enforce at any time or for any period any one or more of the obligations arising under this contract shall not be a waiver of them or of the right at any time subsequently to enforce any or all of such obligations.
  • These Terms constitute the entire agreement between the parties hereto and supersedes prior agreements and understandings between the parties.
  • This contract shall be governed by the laws of England and the parties submit to the exclusive jurisdiction of the English courts.
